For this task the Danish Environmental Protection Agency has planned to rent equipment which in cooperation with the Danish Road Traffic Authority and the Danish National Police are to be used for measurements in Denmark. Moreover there will be purchased help to interpret the readings from the measurements and to produce a concluding report. It’s to be investigated by plume chasing in town area and motorway how much NO in the exhaust gas plumes from lorries contains. The plume chasing method means that reading gear are mounted on a vehicle, which places itself in a lorry plume for measurements. It investigates from cold engine until the SCR (cleaning system) starts to work while driving in the town area. A working temperature engine on a truck is followed through the town area to explain the impact of cleaning efficiency while driving in town areas. There might even be a scrutinizing by data for examining a coherence between load of the engine and size of engine and emission.

The Agency has received intelligence that there is a sole-source provider that has this type of equipment and only this very provider can assess the readings afterwards. Thus the Agency has legally assessed this as a sole-source situation caused by technical reasons cf. “udbudslovens § 80, stk. 3 nr. 2” (Danish public procurement act) as the measurements demand the specific tools and knowhow, which diminish the competition and render impossible to use another provider.

Explanation:

The plume chasing solution demanded for the project requires specific tools and knowhow. The required equipment will make it possible to make the relevant measurements under real-drive circumstances. The Danish Environmental Protection Agency has found, that there are no other suppliers of the required plume chasing equipment.

The Danish Environmental protection Agency follows the procedure set out in § 4 of Consolidation Act No. 593 of 2 June 2016 on The Complaints Board for Public Procurement (in Danish: “Lov om Klagenævnet for Udbud”, available at www.retsinformation.dk). The contract will not be entered before the lapse of 10 calendar days, calculated from the day after that day where this tender notice has been published, cf. § 4(1)(2) in the Act on The Complaints Board for Public Procurement.When the contracting authority follows the procedure set out in § 4, a complain concerning that a tender notice, contrary to the procurement rules, has not been published in the Official Journal of the European Union prior to entering into a contract, shall be brought before the Danish Complaints Board for Public Procurement, within 30 calendar days according to § 7(3) in the Act on The Complaints Board for Public Procurement. The 30 calendar days shall be calculated from the day after that day where the contracting authority has published a notice in the Official Journal of the European Union stating that a contract has been entered, provided that the notice contains an explanation for the contracting authority’s decision to award the framework agreement without publishing a tender notice in the Official Journal of the European Union prior to the entering.
